Copyright Complaint & Content Removal Policy

CatholicInsight.com (“we,” “us,” or “our”) respects the intellectual property rights of others and expects our contributors and visitors to do the same. We are committed to responding to credible claims that material published on CatholicInsight.com infringes copyright or has been plagiarized.

If you believe that content on this site reproduces your copyrighted work without authorization, or that your work has been copied without proper credit, please contact us using the process below. We will review every complaint and, where appropriate, remove or disable access to the material in question.

A note on the applicable law

This site is operated in Canada, and our copyright complaint process is based on the Copyright Act (Canada), R.S.C. 1985, c. C-42, in particular the “notice-and-notice” provisions in sections 41.25 to 41.27.

The operator of this site reviews complaints and will remove or disable access to material where we determine that removal is warranted. This policy describes that voluntary process. It does not replace, limit, or waive any rights or remedies available to us or to any rights holder under Canadian law.

How to submit a copyright complaint

To help us assess your complaint quickly, please provide a written notice that includes the following (based on the requirements in section 41.25(2) of the Copyright Act):

  1. Your contact information — your full name, mailing address, and any other details (such as an email address or phone number) that allow us to communicate with you.
  2. Identification of the work — a clear description of the copyrighted work or other subject-matter you say has been infringed.
  3. Your interest or right — a statement of your interest in or right to the copyright (for example, that you are the copyright owner, an exclusive licensee, or an authorized agent acting on the owner’s behalf).
  4. Location of the material — the exact URL(s) or other location data identifying where the allegedly infringing material appears on this site.
  5. Description of the claimed infringement — an explanation of how the material infringes your copyright.
  6. Date and time — the date and time of the alleged infringement, if known.

We also ask that you include:

    • A statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law; and
    • A statement that the information in your notice is accurate, and that you are the copyright owner or authorized to act on the owner’s behalf.
    • Your signature (an electronic or typed signature is acceptable).

Please do not include in your notice:

    • an offer to settle the claimed infringement;
    • a request or demand for payment or for personal information; or
    • any reference or hyperlink to such an offer, request, or demand.

Notices containing this material do not comply with section 41.25(3) of the Copyright Act and may not be acted upon.

What happens after we receive your complaint

When we receive a complaint that appears complete, we will generally:

  1. Review the material and your notice as soon as reasonably possible.
  2. Remove or disable access to the material voluntarily if we determine that removal is appropriate, in whole or in part, pending or following our review.
  3. Forward your notice to the person who posted the material, where required or appropriate, so they have an opportunity to respond.
  4. Keep records of the notice and any action taken.

We may contact you if we need additional information before we can act.

If your content was removed

If material you posted has been removed or disabled because of a copyright complaint and you believe this was a mistake — for example, because you own the rights, have permission, or the use is permitted under an exception such as fair dealing — you may respond by writing to us at the contact address above.

Please include:

    • your contact information;
    • identification of the material that was removed and its former location on the site;
    • an explanation of why you believe the material should be restored; and
    • a statement that the information you provide is accurate.

We will review your response and decide whether to restore the material. This is a voluntary process we offer; it does not create any obligation on our part and does not affect any party’s legal rights.

Repeat infringers

We may, at our discretion, remove content from and terminate the accounts or contributor privileges of anyone who repeatedly posts material that infringes the copyright of others.

A note on plagiarism

Plagiarism — presenting someone else’s work or ideas as your own without credit — is not always the same as copyright infringement, and it is not addressed by the Copyright Act in the same way. We nonetheless take plagiarism seriously. If you believe content on this site copies your work without proper attribution, please contact us using the details above and describe the concern. We will review it and take appropriate editorial action, which may include adding attribution, correcting, or removing the material.
